Vermont regulator digging into pipeline project

MONTPELIER — Last Thursday, the Public Utility Commission ordered a comprehensive investigation of the methods and practices used by Vermont Gas Systems in the construction of a 41-mile gas pipeline from Colchester to New Haven and on to Middlebury.

On Wednesday the commission had ordered a delay in the assessment against Vermont Gas of a $25,000 fine that had been recommended by the Department of Public Service, saying that a full investigation of the pipeline should be conducted before determining the amount of the fine.

Legislature expected to spar over environmental bills

MONTPELIER — Environmental bills will likely be ground zero for fights between the Scott administration and lawmakers this legislative session.

In the run up to the Jan. 3 opening day, there were flare-ups between environmental advocates, lawmakers and Agency of Natural Resources officials over Act 250 reform legislation, funding for clean up of phosphorus from Lake Champlain and a proposed carbon tax.

State hires expert to verify pipeline depth

MONTPELIER — The Public Utility Commission (PUC) will hire an “independent expert” to check the burial depth of Vermont Gas Systems’ pipeline between Colchester and Middlebury, part of which is closer to the surface than intended.

According to a Dec. 6 PUC order, the expert will look in particular at a half-mile section where the pipeline’s depth doesn’t comply with the permit. The analysis will also check the pipeline’s depth at stream crossings along its 41-mile length.

Electric company seeks 5 percent rate hike

VERMONT — Green Mountain Power’s electric rates are slated to rise by 5 percent in 2018 if the Public Utility Commission approves a deal the state’s largest utility reached this month with the Vermont Department of Public Service.

The deal incorporates approximately $18 million due to GMP customers as a result of terms the company agreed to when it purchased Central Vermont Public Service Corp. in 2012.

The proposed 5 percent rate increase is somewhat lower than it would have been without that sum, said Kristin Carlson, a GMP vice president.

Legislative panel scrutinizes farm exemptions in Act 250

VERMONT — A legislative panel wants to hear the agriculture agency’s case for why farmers should be exempt from environmental enforcement under Vermont’s land use law.

The Act 250 committee, which met Nov. 15, is tasked with proposing fixes to the state’s land use law that will bring 50-year-old regulations up to speed with new environmental pressures.

At the next meeting to be held next month, the committee will ask the Agency of Agriculture to justify land use exemptions for farms.

Proposed per-parcel fee could pay for lake cleanup

VERMONT — Sen. Chris Bray, D-New Haven, has proposed legislation that would fund programs with a per-parcel fee.

The Legislature last spring asked a working group made up of members of Gov. Phil Scott’s cabinet to find a long-term funding source for phosphorus reduction efforts.

In a report released Tuesday, Scott administration officials failed to find a way to pay for Lake Champlain cleanup and suggest that a new revenue source should not be identified until after fiscal year 2021. Scott, a Republican, ran on a no new taxes pledge.

Rule change means more help for addicts

MONTPELIER — In what he called a sign of progress in combating the opioid crisis, Gov. Phil Scott announced this past Monday, Oct. 16, that the state has moved to bolster the ranks of substance abuse counselors by paring back the licensing requirements.

The move was spurred by legislators’ recommendations to the Office of Professional Regulation after hearing that the state’s arcane rules were hindering qualified counselors from landing jobs here, said Sen. Claire Ayer, D-Addison.

Vermont Gas pipeline buried too shallow

NEW HAVEN — Vermont Gas Systems didn’t bury its controversial natural gas pipeline as deeply as it was supposed to, but the company and the state Department of Public Service say that doesn’t pose a problem.

The department says Vermont Gas should be allowed to leave the pipeline as is. However, DPS officials want an investigation into why the company didn’t abide by its permit.

Vermont Gas fined $25,000 for destruction of rare sunflowers

MONKTON — Vermont Gas Systems was fined $25,000 late last month by the Public Service Board for the destruction of a rare plant during the construction of a 41-mile natural gas pipeline into Addison County.

The penalty is in addition to a $33,687.50 fine that the state Environmental Court in December assessed against Vermont Gas for the same incident.
